In the context of what is ‘misleading,’ there are five critical areas to consider:
- Legal Information vs. Legal Advice
- Case Results
- Are we establishing an attorney-client relationship through the contact that we’re making with the client?
- Does ‘contingency fee’ mean free of charge? (This is not something that is addressed in the Model Rules, but it is something that is addressed by many, many States).
- Are you a “Specialist?” If you describe yourself as a specialist or that you “specialize in” a certain area of law, what does that mean to the lay person, and what are the restrictions on that in your State?
